Terms and Conditions for UnSently

Welcome to UnSently (“UnSently,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of https://unsently.com and any related pages, features, content, or services we offer (collectively, the “Site”).
By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Site.
1. Who We Are
UnSently is an online platform that allows users to write, store, and (if they choose) share “unsent letters,” comments, and related content. The goal is to provide a space for emotional expression and reflection—not professional counseling, therapy, or medical treatment.
2. Eligibility
By using the Site, you represent and warrant that:
You are at least 18 years old (or the minimum age required in your jurisdiction).
You have the legal capacity to agree to these Terms.
You are not barred from using the Site under any applicable law.
If you use the Site on behalf of another person or entity, you represent that you are authorized to accept these Terms on their behalf.
3. Account Registration and Security
To use certain features, you may need to create an account.
You agree to provide accurate, current, and complete information during registration and to keep your information updated.
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
You agree to notify us promptly at support@unsently.com if you suspect unauthorized use of your account.
We reserve the right to refuse registration, suspend, or terminate accounts at our discretion if we believe these Terms have been violated.
4. Social Login (e.g., Facebook & Google)
UnSently may allow you to sign up or log in using third-party services such as Facebook and Google.
By using social login, you authorize us to access certain information from that provider (such as your name, email, and profile image) as described in our Privacy Policy.
You are responsible for complying with the terms of the third-party provider (e.g., Facebook and Google’s terms).
Removing the UnSently app from your Facebook or Google account does not automatically delete your UnSently account. To delete your UnSently account and personal data, you must follow the steps described at:

5. User Content and Ownership
You may create, post, or store content on or through the Site, including unsent letters, comments, replies, and other text or media (“User Content”).
You retain any ownership rights you have in your User Content.
By submitting User Content on the Site, you grant UnSently a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, store, reproduce, modify, adapt, distribute, display, and perform your User Content as reasonably necessary to operate, improve, and promote the Site and our services.
This license continues for as long as your content is stored on our systems. If you delete your account, we may delete or anonymize your User Content, or in some cases retain anonymized versions to preserve the integrity of conversations or the platform.
You are solely responsible for your User Content and for any consequences of posting or sharing it.
6. Prohibited Content and Conduct
You agree that you will not use the Site to:
Post content that is unlawful, defamatory, abusive, harassing, threatening, hateful, or discriminatory.
Post content that promotes self-harm, violence, or harm toward others.
Post content that includes highly sensitive personal or financial information (such as Social Security numbers, full credit card information, or other data that could lead to identity theft).
Post content that infringes or violates the rights of others, including intellectual property rights, privacy rights, or publicity rights.
Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
Engage in spamming, phishing, or other unsolicited marketing.
Attempt to hack, disrupt, interfere with, or reverse engineer any part of the Site.
Upload malware, viruses, or other harmful code.
We reserve the right (but have no obligation) to review, monitor, and remove any User Content that we believe violates these Terms, our policies, or applicable law.
7. No Professional Advice / Emergency Disclaimer
UnSently is not a substitute for professional advice. The Site and its content are for personal reflection, expression, and support—not medical, mental health, psychological, or legal advice.
We do not provide therapy, counseling, crisis services, or medical treatment.
Nothing on the Site should be used to diagnose or treat any condition.
If you are in crisis, thinking about self-harm, or believe someone else is in danger:
Call your local emergency number (such as 911 in the United States),
Contact a crisis hotline or trusted professional immediately.
Do not rely on UnSently or any user-generated content on the Site for emergency help.
8. Intellectual Property
All content on the Site, except for User Content, is owned or licensed by UnSently and is protected by copyright, trademark, and other intellectual property laws. This includes:
Site design and layout
Logos and branding
Text, graphics, and images we create
Software and code used to operate the Site
You may not copy, modify, distribute, sell, or create derivative works based on any part of the Site without our prior written consent, except as allowed by these Terms or applicable law.
9. Third-Party Links and Services
The Site may contain links to third-party websites or services that are not owned or controlled by UnSently.
We are not responsible for the content, policies, or practices of any third-party sites or services.
Your use of third-party services is at your own risk and subject to their own terms and policies.
This includes, but is not limited to, social login providers like Facebook.
10. Privacy
Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

By using the Site, you consent to the collection and use of your information as described in the Privacy Policy.
11. Account Termination and Suspension
We reserve the right, in our sole discretion, to suspend or terminate your account or access to the Site, with or without notice, if we believe:
You have violated these Terms or our Privacy Policy,
Your use poses a risk to the Site or other users,
We are required to do so by law or legal process.

Upon termination:
Your right to use the Site will end.
We may delete or anonymize your User Content, but some data may be retained as described in our Privacy Policy (for legal, security, or record-keeping reasons).
12. Disclaimers
The Site and all content and services provided through it are offered on an “as is” and “as available” basis, without any warranties of any kind, whether express or implied.
To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:
Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Any warranties that the Site will be uninterrupted, secure, or error-free.
Any warranties regarding the accuracy, completeness, or reliability of any content (including User Content).
You use the Site at your own risk.
13. Limitation of Liability
To the fullest extent permitted by law, UnSently, its owners, officers, employees, and affiliates will not be liable for any:
Indirect, incidental, special, consequential, or punitive damages,
Loss of profits, data, or goodwill,
Other intangible losses,
arising out of or in connection with:
Your use of or inability to use the Site,
Any conduct or content of any user or third party,
Any unauthorized access, use, or alteration of your transmissions or content,
Any content you may find offensive, harmful, inaccurate, or deceptive.
In no event shall our total liability for all claims related to the Site exceed the greater of:
The amount you paid us (if any) in the last 12 months, or
One hundred U.S. dollars (USD $100).
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
14. Indemnification
You agree to indemnify, defend, and hold harmless UnSently, its owners, officers, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in connection with:
Your use of the Site,
Your User Content,
Your violation of these Terms,
Your violation of any rights of another person or entity.
15. Governing Law and Dispute Resolution
These Terms and your use of the Site are governed by the laws of the State of Texas, without regard to its conflict of law principles.
You agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Site shall be resolved in the state or federal courts located in Texas, USA, and you consent to the personal jurisdiction and venue of such courts.
16. Changes to These Terms
We may update or modify these Terms from time to time.
When we do, we will change the “Last updated” date at the top.
We may also provide notice on the Site or by email if the changes are significant.
By continuing to use the Site after changes become effective, you agree to the revised Terms. If you do not agree to the new Terms, you must stop using the Site.
17. Severability
If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy and any other posted guidelines or policies, constitute the entire agreement between you and UnSently regarding your use of the Site and supersede any prior or contemporaneous agreements, communications, or understandings.
